GENERAL
Should any of the conditions herein be in conflict with those of the buyer, these conditions shall prevail. Placing an order by email, fax, telephone, letter, in person or internet constitutes acceptance of the above terms and conditions. If the customer is dealing in the capacity of a consumer then these terms and conditions shall not affect their statutory rights. The price of goods for export/ overseas orders does not include transportation costs or import or export duty or documentation charges of any kind. The payment of which is the responsibility of the recipient of the goods. Age restricted goods are not for sale to persons under the age of 18. By placing an order for knives you are indicating that you are over 18 years of age or over. Images are for illustration purposes and are an example only. Colour and finish may vary due to computer monitor configuration. PAYMENTS For information on payments i.e. credit cards, bank transfers, 30 day accounts and cheques please contact us. Note: It you can take up to 7 days for some cheques to clear and credit card payments may incur a levy subject to bank tariffs. Placing an order constitutes acceptance of the above terms & conditions www.ebiycle WARRANTY Goods will be supplied with the manufacturers warranty and will correspond with their description and specification being free from defects in material and workmanship for a period of 12 months from delivery unless otherwise stated in the products description or agreed in writing by us. www.ebicycle.ie shall be under no liability under any warranty, condition or guarantee if the goods in question have not been paid for in full. The Company shall be under no liability for any defects arising from incorrect installation, negligence, fair wear and tear, damage, incorrect use, or lack of maintenance including following manufacturer’s servicing recommendations. Where applicable, parts and labour guarantee only applies to goods supplied in Ireland. Some manufacturers operate a “return to base” guarantee whereby the goods must be returned to them, the Company does not offer replacement or loan equipment in these cases unless otherwise stated. Consumable parts are not covered under guarantee. We will not authorise any warranty call during the warranty period without the prior authorisation (to us) of the manufacturer. The manufacturer shall dictate the service arrangements. Except in respect of death or personal injury caused by The Company’s negligence, the Company is not responsible for any consequential loss or damages connected to the breakdown or failure of goods supplied (including loss of business, contracts or profits). The buyer shall notify the Company within 2 days from the delivery date of any defect in the quality or condition of the goods or if the goods differ from their description/specification in any way. The Company shall have no liability for any defect or failure if the buyer does not report such a loss/defect within this time indicated. In the event of any valid claim in respect of the quality or condition of any goods supplied by the Company that is notified under these terms then the Company reserves the right to repair or replace the goods or part in question, refund the price or part of the price of the goods at its sole discretion and shall have no further liability to the Buyer. Goods replaced by the manufacturer during any warranty period will be guaranteed under the manufacturers terms for the unexpired portion of the original warranty. If a customer authorises a repair or work to a product within the manufacturers guarantee period that has not been authorised by us or the manufacturer then that repair/work may invalidate the product guarantee. The Company shall not be in breach of contract or liable to the Buyer if any delay in supplying goods, or failure to perform any of its obligations in relation to the goods supplied was due to any cause beyond the Company’s reasonable control. We shall have no liability for any failure or delay in supply or delivery or for any damage or defect to goods or parts supplied or delivered hereunder that is caused by any event or circumstances beyond our reasonable control (including without limitation, strikes, lockouts and other industrial disputes). Terms and Conditions of Hire Hirers must provide identification showing permanent address (driving licence, passport or similar) and where applicable car registration number. The right to hire is at our description. Hirers are responsible for the bike and other equipment including lost, stolen or damaged items in their care and agrees to reimburse us with the full cost of replacement or repair. By accepting the hire of the electric bicycle, the hirer acknowledges that the bike and its accessories are roadworthy and drivable. It is the hirers responsibility to use the bicycle with due care and attention and in conformance with the legal regulations, including all road traffic regulations. It is the responsibility of the hirer to ensure that only he/she rides the electric bike and may only use the bicycle for its intended purpose. The bike is your responsibility and you should ensure that it is locked and secured in a safe location including the battery pack. Any damage done to the electric bike will be your responsibility to repair or bear the cost of said repair. Should you be involved in a accident, you must provide us with a written statement and any relevant details. The bike must be returned to us as agreed on hire day, if it is returned later than agreed extra charges will be applied. |
